The Perch

The rules of the road.

Who you’re agreeing with

The Perch (the mobile app, perchgolf.com and app.perchgolf.com) is operated by Perch Golf LLC, a California limited liability company. Where these terms say “we” or “us,” they mean Perch Golf LLC. By creating an account or using The Perch you agree to these terms, our Privacy Policy, our Community Guidelines, our Refund Policy and how money works.

Your account

You need to be at least 13 years old. If you’re under 18, a parent or guardian must agree to these terms for you, and you shouldn’t put money on games or side bets. By creating an account you confirm the information you give us is accurate. One account per person.

You’re responsible for what happens under your account. Keep your password to yourself, and tell us at hello@perchgolf.com if you think someone else has used it.

Your content

Your scores, profile, posts, photos and messages belong to you. By posting them you give us a non-exclusive, worldwide, royalty-free license to host, store, copy, display and share them as needed to run The Perch: in the app and on our websites (including public profiles, round pages, leaderboards, event pages and TV boards when your settings or the event allow it), in share images and emails, and with the service providers that help us run it, including the AI provider behind Albie. The license ends when you delete the content, except where it has already been shared with others or is kept as our Privacy Policy describes.

Only post content you have the right to post. If you send us ideas or feedback, we can use them without owing you anything.

Playing fair

Follow the Community Guidelines. In short:

We can remove content, limit features, or suspend or close accounts that break these rules.

Games, stakes and side bets

When you set a stake or accept a side bet, The Perch only tracks who would owe whom based on the scorecard. We don’t process, hold or move money for games or side bets, we don’t take a cut, and we don’t settle disputes. The “Pay via Venmo” link on the ledger just opens Venmo; that payment is between you and the other player. Friendly wagers between players are legal in many places when no one takes a cut, but laws vary, and it’s your responsibility to follow yours. See how money works.

Calcuttas work the same way. The Perch only records the lots, bids and payouts the host enters; we don’t take, hold or pay out any Calcutta money. Calcuttas are for adults only, and the host is responsible for following the law where the event is played.

Events, leagues and clubs

Events, leagues and clubs on The Perch are run by their hosts, not by us (unless an event says it’s run by Perch Golf LLC). The host sets the format, price, rules, refund policy and schedule, and decides results; we provide the software. Golf has real risks. When you register, you accept the risks of playing and the waiver the host shows you, which releases the host and Perch Golf LLC from liability to the extent the law allows.

Some events are for adults only and ask you to confirm you’re 18 or older; don’t register for them if you aren’t.

Trip plans help a group decide where and when to play. The Perch doesn’t book or sell travel; book directly with the course or resort.

Paying for events

Entry fees, add-ons, donations, auction wins, sponsorships and team invoices are paid by card through Stripe. The money goes to the host’s Stripe account, minus Stripe’s processing fees and Perch’s registration fee.

Hosting on The Perch

If you host an event, league or club, you also agree that:

Subscriptions

Perch Prime costs $9.99 a month or $99.99 a year and has no free trial. Host plans (Plus and Pro) and the white-label add-on are priced on our pricing page; host plans start with a 30-day free trial and need a card. You’ll see the price before you buy.

Founding members, referrals and codes

Albie, scores and distances

Albie, our AI assistant, and a round’s Albie Insights are generated by AI. Their answers, including Rules of Golf rulings, are guidance and can be wrong. In a competition, the committee or the event host has the final word. Check anything that matters, and review scanned scorecards before you post them.

Your estimated handicap is calculated from the rounds you post on The Perch. It isn’t an official World Handicap System or GHIN handicap. GPS distances and course maps are estimates; check that a distance-measuring device is allowed before using one in competition.

Other services

The Perch connects to services we don’t control, such as Stripe, Apple, Google, Venmo and map providers. Their own terms apply when you use them, and we aren’t responsible for them.

If you use the iPhone app

These terms are between you and Perch Golf LLC, not Apple. Apple isn’t responsible for the app, its content, maintenance or support, or for any claim about it (including product liability, legal compliance or intellectual-property claims). If the app fails to meet a warranty that applies, you can ask Apple to refund its purchase price, and Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them. You confirm you aren’t in a country under a US government embargo and aren’t on a US government list of restricted parties.

Copyright complaints

If you believe something on The Perch infringes your copyright, email hello@perchgolf.com with the work, where it appears on The Perch, your contact details, and a statement that you believe in good faith the use isn’t authorized. We’ll remove infringing content and close the accounts of repeat infringers.

Ending things

You can stop using The Perch and delete your account any time in Settings > Account > Danger zone. We can suspend or close an account that breaks these terms or puts others at risk, and we may change or stop features. If we shut down a paid service, we’ll give notice and refund unused prepaid time.

No warranty

The Perch is provided “as is” and “as available.” We work hard on it, but we don’t promise it will be uninterrupted or error-free, or that scores will always sync instantly. Don’t rely on it for anything critical.

Limitation of liability

To the extent the law allows, Perch Golf LLC isn’t liable for indirect, incidental, special or consequential damages, or for lost profits or data, from your use of The Perch, or for what hosts or other players do. Our total liability to you for any claim won’t exceed the greater of $100 or what you’ve paid us in the 12 months before the claim. Some places don’t allow these limits, so they may not all apply to you.

If you use The Perch in a way that breaks these terms or the law (for example, running an event unlawfully), you agree to cover the costs and claims that result for Perch Golf LLC.

Governing law and disputes

These terms are governed by the laws of the State of California and the United States, without regard to conflict-of-laws rules. If you have a problem, email us first and give us 30 days to try to fix it. If we can’t, disputes go to the state or federal courts in California, though either of us can use small-claims court where it applies.

Map and course data

The Perch’s on-course GPS distances combine several data sources. Satellite map imagery is provided by MapTiler. Course names, addresses and scorecard data come from the Golf Course API. Hole geometry (green centers, fronts and backs, tee box positions) is partly derived from © OpenStreetMap contributors, licensed under the ODbL. Some geometry is mapped by us and by golfers who help map courses; corrections apply on top of the OpenStreetMap-derived base under the same license.

Changes to these terms

We may update these terms. If we make a meaningful change, we’ll update the effective date above and tell you in the app or by email before it takes effect. If you keep using The Perch after that, the new terms apply.
